Municipal Law Seminar: Attorney Conduct Sessions

1:30 – 2:30 p.m.

GRIEVANCE PROCESS

Ernest F. McAdams, Jr., Chief Prosecutor, Cincinnati (retired)

Municipal Attorneys do not think that grievances will be filed against them so they are not aware of the traps that they can fall into. This will be a discussion of things that attorneys should do to avoid a grievance filing against them. The presenter will give many examples. There also may be cases in which the municipal attorney should file a grievance himself/herself.

3:00 – 4:30 p.m.

BEST PRACTICES FOR MUNICIPAL OFFICIALS – TO FOLLOW ETHICS LAWS

Rod Davisson, Village Solicitor, Obetz, former Mayor of Obetz, Attorney

Understanding the Ohio ethics laws and their interplay with the Ohio Rules of Professional responsibility is critical to the success of the municipal attorney; and, by extension, their public clients. To that end, we shall explore best practices for advising municipal clients with respect to the Ohio Ethics Laws applicable to local governments.  We will consider the Ohio prohibitions against bribery, self-interest, and nepotism, and discuss the attorney’s obligations for representation in such matters under OH ST RPC Rules 1.11 and 1.13.
